Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the website operated by LAMED FLY CENTER SRL (CUI: 45318315, Reg. No.: J20/21005925/123), operating as LaMed Aviation Medical Centre ("LaMed", "we", "us", or "our"), with its registered office at Str. Baia Mare 15, Cluj-Napoca 400171, Cluj County, Romania, and its clinic at Str. Nicolae G. Caramfil 87, Bucharest 014142, Romania. By accessing or using our website and services, you agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must not use our website or services.

LaMed is a private aeromedical centre authorised to conduct medical examinations in accordance with European Union Aviation Safety Agency (EASA) Part-MED regulations. These Terms apply to all visitors, users, and customers who access our website or book our services.

2. Services

LaMed provides aeromedical examination services for aviation professionals, including but not limited to:

  • Class 1 Medical Certificates — initial examinations, revalidations, and renewals for airline transport pilots and commercial pilots.
  • Class 2 Medical Certificates — initial examinations, revalidations, and renewals for private pilots.
  • Class 3 Medical Certificates — initial examinations, revalidations, and renewals for air traffic controllers.
  • Cabin Crew Medical Assessments — medical examinations required for cabin crew members under EASA regulations.

All examinations are carried out by EASA-authorised Aeromedical Examiners (AMEs) in compliance with applicable EASA Part-MED regulations and Romanian civil aviation authority (AACR) requirements.

3. Booking Process

To book a medical examination through our website, you must:

  1. Complete the booking form with accurate personal information, including your full name, telephone number, and selected service type.
  2. Select an available appointment date from the calendar provided.
  3. Review your booking details and proceed to payment via our secure payment processor.
  4. Upon successful payment, you will receive a confirmation email with your booking reference, appointment details, and preparation instructions.

By submitting a booking and completing payment, you enter into a binding agreement with LaMed for the provision of the selected medical examination service on the chosen date.

4. Reservation Fee and Payment

A reservation fee of 20,00 € is required to secure your appointment. This fee is payable at the time of booking and covers the reservation of medical resources, specialist availability, and administrative preparation for your examination.

All payments are processed securely by Stripe, Inc., an independent, PCI-DSS Level 1 certified payment processor. LaMed does not collect, process, store, or have access to your credit or debit card details at any time. Your payment information is transmitted directly to and handled exclusively by Stripe in accordance with their own Privacy Policy and Terms of Service.

The remaining balance for your medical examination (if applicable) is due on the day of your appointment at our clinic. Accepted payment methods for the remaining balance will be communicated in your confirmation email.

5. No Refunds Policy

The reservation fee of 20,00 € is strictly non-refundable once payment has been completed. This policy applies regardless of the reason for cancellation, including but not limited to:

  • Change of mind or personal circumstances preventing attendance.
  • Failure to attend the scheduled appointment (no-show).
  • Travel disruptions, visa issues, or other logistical difficulties.
  • Medical conditions discovered before or during the examination that may affect the outcome.

The non-refundable nature of the reservation fee reflects the costs incurred by LaMed upon booking, including the allocation of specialist medical personnel, diagnostic equipment, laboratory resources, and administrative preparation specifically for your appointment.

By completing payment, you acknowledge and accept this no-refunds policy in full.

6. Cancellation and Rescheduling

If you need to reschedule your appointment, please contact us as soon as possible at office@clinicalamed.com or +40 723 577 452.

Rescheduling is subject to availability and is not guaranteed. We will make reasonable efforts to accommodate your request, but LaMed reserves the right to decline rescheduling if no suitable alternative dates are available.

Cancellation of a booking does not entitle you to a refund of the reservation fee, in accordance with Section 5 of these Terms.

7. Your Obligations

When using our website and services, you agree to:

  • Provide accurate, complete, and truthful personal information in all forms and communications with LaMed.
  • Be at least 16 years of age or have the consent of a parent or legal guardian to book and attend a medical examination.
  • Arrive at the clinic on time for your scheduled appointment, with all required documentation.
  • Bring a valid passport or government-issued identification document, any previous medical certificates, a list of current medications, and prescription glasses or contact lenses if applicable.
  • Disclose all relevant medical history honestly and completely to the examining physician.
  • Refrain from using the website for any unlawful purpose, including submitting fraudulent bookings or providing false information.

8. Medical Examination Disclaimer

LaMed does not guarantee the issuance of a medical certificate. The outcome of any medical examination is determined solely by your health status and the applicable EASA Part-MED regulations. The examining AME (Aeromedical Examiner) is required to make an independent, objective medical assessment.

In cases where a certificate cannot be issued immediately, a deferral or limitation may be applied in accordance with EASA regulations. Such outcomes are not grounds for a refund of the reservation fee, as the medical examination itself has been conducted and the allocated resources have been utilised.

9. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, brand names, and software, is the property of LaMed Aviation Medical Centre or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this website without prior written consent from LaMed.

10. Limitation of Liability

To the maximum extent permitted by applicable law, LaMed shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our website or services, including but not limited to loss of revenue, loss of profit, loss of business, or loss of data.

In any event, the total aggregate liability of LaMed arising out of or related to these Terms or your use of our services shall not exceed the amount of the reservation fee you have paid.

LaMed shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, government actions, strikes, power failures, or technical disruptions (force majeure).

11. Third-Party Services

Our website integrates with third-party services to facilitate payment processing and other functionality. In particular, payment transactions are handled by Stripe, Inc. Your use of Stripe is governed by Stripe's own terms and conditions, which you agree to when completing a payment.

LaMed is not responsible for any interruptions, errors, or failures of third-party services. In the event that a payment cannot be processed due to a third-party issue, we will work with you to resolve the matter, but LaMed shall not be held liable for delays or failures caused by external service providers.

12. Modifications to These Terms

LaMed reserves the right to modify or update these Terms at any time. Changes will be effective immediately upon posting the revised Terms on this page, with the "Last updated" date amended accordingly. Your continued use of the website and services after any such changes constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically to stay informed about any updates.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Bucharest, Romania.

If you are a consumer residing in the European Union, you may also be entitled to invoke the mandatory consumer protection provisions of the law of your country of residence, and you may submit a dispute to the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

14. Severability

If any provision of these Terms is found to be invalid, unenforceable, or illegal by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
